1. Agreement to Terms
By accessing and using the Marshall Education website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Use of Services
2.1 Eligibility
You must be at least 18 years old to register for courses and use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2.2 Account Registration
When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
2.3 Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose or in violation of any laws
- Impersonate any person or entity or falsely represent your affiliation
- Share course materials with unauthorized third parties
- Attempt to gain unauthorized access to our systems or networks
- Interfere with or disrupt the Services or servers
- Engage in academic dishonesty or cheating on assessments
3. Course Enrollment and Payment
3.1 Course Registration
Course enrollment is subject to availability. We reserve the right to cancel or reschedule courses. In such cases, you will be offered a full refund or the option to transfer to another course.
3.2 Fees and Payment
All fees must be paid in full before course commencement unless alternative payment arrangements have been agreed upon in writing. Prices are subject to change, but enrolled students will be charged the price at the time of enrollment.
3.3 Refund Policy
Our refund policy is as follows:
- Full refund if cancellation is made 30+ days before course start
- 50% refund if cancellation is made 15-29 days before course start
- No refund for cancellations made less than 15 days before course start
- No refund once course access has been provided
Exceptions may be made on a case-by-case basis for extenuating circumstances.
4. Intellectual Property Rights
4.1 Our Content
All course materials, content, features, and functionality (including but not limited to text, graphics, logos, images, videos, and software) are owned by Marshall Education or our licensors and are protected by copyright, trademark, and other intellectual property laws.
4.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use course materials for your personal educational purposes only. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any materials without our prior written consent.
5. Certification and Accreditation
Certificates are awarded upon successful completion of course requirements as determined by the relevant accrediting body (NEBOSH, IEMA, etc.). Marshall Education reserves the right to:
- Withhold certificates if course requirements are not met
- Revoke certificates if academic dishonesty is discovered
- Update certificate requirements in accordance with accrediting body standards
6. Student Conduct and Academic Integrity
Students are expected to:
- Complete all coursework independently unless group work is specified
- Not engage in plagiarism, cheating, or any form of academic dishonesty
- Respect instructors, staff, and fellow students
- Attend scheduled sessions and meet deadlines
- Report any concerns about academic integrity
Violations may result in course failure, certificate revocation, and termination of access to our Services.
7. Disclaimers and Limitations of Liability
7.1 Service Availability
We strive to provide uninterrupted access to our Services but do not guarantee that the Services will always be available, error-free, or secure. We reserve the right to suspend or discontinue Services for maintenance or other reasons.
7.2 No Employment Guarantee
While our courses are designed to enhance career prospects, we do not guarantee employment, certification success, or specific career outcomes.
7.3 Limitation of Liability
To the fullest extent permitted by law, Marshall Education shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.
8. Indemnification
You agree to indemnify, defend, and hold harmless Marshall Education and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your use of the Services.
9. Third-Party Services
Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party services is at your own risk.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website with a revised date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
11. Termination
We may terminate or suspend your access to the Services immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Services will cease immediately.
